These Terms and Conditions (“Terms”) govern access to and use of the Premier Indoor Golf facility, website, online services, memberships, and related offerings (collectively, the “Services”). By accessing the Services, creating an account, signing a membership agreement, or using the facility, you agree to be bound by these Terms. By signing/acknowledging digitally, you acknowledge that my electronic signature/acknowledgement carries the same legal force and effect as a handwritten signature under applicable law.
GENERAL TERMS AND CONDITIONS

2. ELIGIBILITY
You must be at least 18 years of age to enter into a membership agreement. Minors may use the facility with direct supervision at all times and consent of a parent or legal guardian, subject to Company policies. All guests must accept the terms and conditions of the facility and also must accept the terms of the waiver via the form found at the bottom of this page.
3. MEMBERSHIPS & ACCOUNTS
Membership access and benefits are governed by the applicable Membership Agreement. Members are responsible for maintaining accurate account information. Sharing access credentials or allowing unauthorized use is prohibited. Premier Indoor Golf reserves the right to make changes to the membership details at any given time, suspend, or terminate accounts for violations of these Terms or the Membership Agreement.
4. BOOKINGS, ACCESS & FACILITY USE
Simulator reservations may be made by members and non-members, subject to availability and booking rules. Non-member bookings may require advance payment and are subject to posted rates. Late arrivals may result in reduced session time without refund. Premier Indoor Golf may modify hours of operation, close temporarily for maintenance, or limit access for private events. Members and non-members must comply with all posted rules, signage, and staff instructions.
5. PAYMENTS & BILLING
Membership fees and other charges are billed in accordance with the applicable Membership Agreement. Automatic ACH billing is used for recurring membership payments. Members are responsible for maintaining valid payment information. Failed or returned payments may result in suspension of access and additional fees.
6. CANCELLATIONS & REFUNDS
Membership cancellation terms are governed exclusively by the Membership Agreement. Non-member simulator bookings are subject to the cancellation and rescheduling policies displayed at the time of booking. One-time bookings, retail purchases, and events are non-refundable unless otherwise required by law. No refunds will be issued for unused time, missed bookings, or voluntary non-use.
7. CODE OF CONDUCT
All members, guests, and visitors must conduct themselves in a respectful and safe manner, refrain from abusive, threatening, or disruptive behavior, follow all safety guidelines and equipment instructions, and avoid damaging equipment or property. Premier Indoor Golf reserves the right to remove individuals from the facility and/or terminate access for violations of this section.
ALCOHOL CONSUMPTION & RESPONSIBILITY:
If you choose to consume alcoholic beverages on the premises, you agree that you must present valid proof of legal drinking age as requested, you will drink responsibly and understand that excessive alcohol consumption increases the likelihood of injury, you accept full responsibility for any injury, damage, or incident resulting from impairment, and you will not operate equipment if visibly impaired.
8. EQUIPMENT & PROPERTY DAMAGE
Users are responsible for any damage caused by misuse, negligence, or failure to follow instructions. Charges for repair or replacement may be assessed to the responsible party. You agree to follow all posted rules and staff instructions. Please ensure all club equipment has been inspected and is securely fastened (club heads).
9. ASSUMPTION OF RISK
Use of golf simulators, practice equipment, and related activities involves inherent risks, including but not limited to bodily injury or property damage. You voluntarily assume all such risks associated with participation and understand that participating in activities at Premier Indoor Golf (“the Facility”), including but not limited to golf simulator use, lessons, league play, practice sessions, events, alcohol service areas, and related activities, involves inherent risks such as: Being struck by golf balls, clubs, or equipment, slips, trips, falls, or collisions, injuries caused by other participants, equipment failure or malfunction, injuries occurring while consuming alcohol on premises, and you voluntarily assume all such risks.
10. RELEASE OF LIABILITY
To the fullest extent permitted by Kansas law, you release and hold harmless Premier Indoor Golf, its owners, employees, contractors, and affiliates from any claims, injuries, damages, or losses arising out of or related to your use of the Services or facility, except where caused by gross negligence or willful misconduct. You agree to indemnify and hold harmless Premier Indoor Golf from any claims or expenses arising from my participation.
11. HEALTH & SAFETY
You acknowledge that you are physically capable of participating in golf-related activities and agree to stop participation if you experience discomfort, injury, or unsafe conditions. You agree to comply with all health and safety rules. You authorize Premier Indoor Golf to obtain/administer medical treatment in the event of injury.
12. PHOTOGRAPHY & MEDIA RELEASE
Premier Indoor Golf may capture photos or videos within the facility for marketing or promotional purposes. By entering the facility, you consent to such use unless you provide written notice opting out.
13. INTELLECTUAL PROPERTY
All content, logos, trademarks, software, and materials associated with Premier Indoor Golf are the exclusive property of the Company and may not be used without prior written consent.
14. PRIVACY
Personal information is handled in accordance with the Company’s Privacy Policy. By using the Services, you consent to the collection and use of information as described therein.
15. SUSPENSION & TERMINATION
Premier Indoor Golf may suspend or terminate access to the Services for members or non-members, without refund, for violations of these Terms, non-payment, or conduct that jeopardizes safety, equipment, or operations. If any portion of this agreement is found unenforceable, the remainder shall remain in effect.
16. DISCLAIMER OF WARRANTIES
The Services are provided on an “AS IS” and “AS AVAILABLE” basis. Premier Indoor Golf makes no warranties, express or implied, regarding availability, accuracy, or fitness for a particular purpose.
17. LIMITATION OF LIABILITY
To the maximum extent permitted by Kansas law, Premier Indoor Golf shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to use of the Services.
18. GOVERNING LAW & VENUE
These Terms shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to conflict-of-law principles. Venue for any dispute shall lie exclusively in the state or federal courts located within Kansas.
19. CHANGES TO TERMS
Premier Indoor Golf reserves the right to update or modify membership details including these Terms at any time. Updated Terms will be posted and effective upon posting. Continued use of the Services constitutes acceptance of the revised Terms.
MINOR & GUEST WAIVER ADDENDUM
This Minor & Guest Waiver Addendum (“Addendum”) is incorporated into and forms part of the Premier Indoor Golf Terms and Conditions and, where applicable, the Membership Agreement. This Addendum applies to all non-member guests and minors who access or use the Premier Indoor Golf facility. By signing/acknowledging digitally, I acknowledge that my electronic signature carries the same legal force and effect as a handwritten signature under applicable law.
1. APPLICABILITY
This Addendum applies to all non-member guests, including individuals booking simulators on a one-time basis, and all minors under the age of eighteen (18) who enter or use the facility. Entry into the facility constitutes acknowledgment and acceptance of this Addendum.
2. GUEST ACKNOWLEDGMENT & ASSUMPTION OF RISK
All guests acknowledge that participation in golf-related activities, including the use of golf simulators, practice equipment, and facilities, involves inherent risks that may result in personal injury, property damage, or other harm. Guests voluntarily assume all risks associated with use of the facility, whether known or unknown, and agree to comply with all posted rules, safety guidelines, and staff instructions.
3. RELEASE OF LIABILITY (GUESTS)
To the fullest extent permitted by Kansas law, guests release and hold harmless Premier Indoor Golf, its owners, members, managers, employees, contractors, and affiliates from any and all claims, demands, injuries, damages, losses, or liabilities arising out of or related to the guest’s presence at or use of the facility, except where caused by gross negligence or willful misconduct.
4. MINOR PARTICIPATION REQUIREMENTS
Minors may only enter or use the facility while under direct supervision by a parent or legal guardian. A parent or legal guardian must execute this Addendum on behalf of the minor prior to participation. The accompanying parent or legal guardian is responsible for the minor’s supervision, conduct, and compliance with all facility rules. Premier Indoor Golf reserves the right to deny access or participation to any minor not properly accompanied or supervised.
5. PARENTAL CONSENT, ASSUMPTION OF RISK & INDEMNIFICATION
By signing below or acknowledging digitally, the parent or legal guardian acknowledges and agrees that they are the lawful parent or legal guardian of the minor identified below, they consent to the minor’s participation in all activities at Premier Indoor Golf, they understand and accept all risks associated with such participation on behalf of the minor, and they agree to indemnify and hold harmless Premier Indoor Golf from any claims brought by or on behalf of the minor arising from the minor’s participation, except where prohibited by Kansas law
6. MEDICAL AUTHORIZATION (MINORS)
In the event of an emergency, the parent or legal guardian authorizes Premier Indoor Golf to obtain medical treatment for the minor if they cannot be promptly reached. All medical expenses incurred shall be the responsibility of the parent or legal guardian.
7. MEDIA RELEASE (MINORS & GUESTS)
Guests and parents/guardians of minors grant Premier Indoor Golf permission to use photographs or video recordings taken within the facility for marketing or promotional purposes, unless written notice opting out is provided.
8. GOVERNING LAW
This Addendum shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to conflict-of-law principles.
9. ELECTRONIC EXECUTION
This Addendum may be executed electronically and shall be legally binding in accordance with the Kansas Uniform Electronic Transactions Act (K.S.A. 16-1601 et seq.). Electronic acceptance applies equally to guests and to parents or legal guardians signing on behalf of minors.
LEAGUES, TOURNAMENTS & LESSONS ADDENDUM (UPDATED FOR PAYOUTS & CONTRACOTR INSTRUCTORS)
This Leagues, Tournaments & Lessons Addendum (“Addendum”) is incorporated into and forms part of the Premier Indoor Golf Membership Agreement, Terms and Conditions, and Minor & Guest Waiver Addendum (collectively, the “Agreements”). Participation in any league, tournament, clinic, or lesson constitutes acceptance of this Addendum.
1. APPLICABILITY
This Addendum applies to all participants in leagues, tournaments, clinics, coaching sessions, and instructional lessons. Participants may include members, non-members, adults, and minors (subject to parental requirements).
2. REGISTRATION & FEES
Separate registration fees may apply for leagues, tournaments, or lessons. All fees must be paid in advance unless otherwise stated. Registration fees are non-refundable, except as required by Kansas law or expressly stated in writing. Leagues may involve cash or prize payouts. Premier Indoor Golf is not responsible for taxation or reporting; participants are responsible for all applicable tax obligations.
3. SSCHEDULING & ATTENDANCE
Schedules, match times, lesson appointments, and formats are subject to change. Missed sessions, matches, or lessons due to participant unavailability are not eligible for refunds or make-ups unless expressly approved. Premier Indoor Golf reserves the right to reschedule or cancel events due to low enrollment, instructor availability, equipment issues, or other operational needs.
4. SKILL LEVEL & INSTRUCTION DISCLAIMER
Golf instruction and coaching are provided for educational and recreational purposes only. No guarantee is made regarding skill improvement, performance outcomes, or competitive results. Participants are responsible for determining whether activities are appropriate for their skill level and physical condition. Instructors providing lessons or clinics are independent contractors and not employees of Premier Indoor Golf.
5. ASSUMPTION OF RISK
Participation in leagues, tournaments, and lessons involves inherent risks, including physical injury and property damage. Participants voluntarily assume all such risks, whether participating competitively or recreationally.
6. RELEASE OF LIABILITY
To the fullest extent permitted by Kansas law, participants release and hold harmless Premier Indoor Golf, its owners, employees, instructors, contractors, and affiliates from any claims or liabilities arising out of participation, except where caused by gross negligence or willful misconduct.
7. MINORS IN PROGRAMS
Minors may participate only while accompanied by a parent or legal guardian. A parent or legal guardian must execute the Minor & Guest Waiver Addendum prior to participation. The parent or legal guardian assumes responsibility for the minor’s conduct, safety, and compliance during participation.
8. CONDUCT & SPORTSMANSHIP
Participants agree to act in a sportsmanlike manner, follow all rules, formats, and instructor directions, and refrain from disruptive, abusive, or unsafe behavior. Premier Indoor Golf reserves the right to remove participants from any program without refund for violations.
9. MEDIA RELEASE
Participants grant Premier Indoor Golf permission to use photographs or video recordings from leagues, tournaments, or lessons for marketing or promotional purposes unless written notice opting out is provided.
10. GOVERNING LAW
This Addendum shall be governed by and construed in accordance with the laws of the State of Kansas.
11. ELECTRONIC ACCEPTANCE
This Addendum may be accepted electronically and is legally binding pursuant to the Kansas Uniform Electronic Transactions Act (K.S.A. 16-1601 et seq.).
12. ACKNOWLEDGMENT
By registering for or participating in any league, tournament, or lesson, the participant (and parent or legal guardian, if applicable) acknowledges understanding and acceptance of this Addendum.
